1. Acceptable Use Policy

It is prohibited to use the System for purposes of fraud, distribution of viruses, malware, or any activity that harms individuals, property, or the System.

3.2 Prohibited Content

The User agrees not to create, share, or distribute Content that:

1. Intellectual Property Rights

We grant the User a limited, non-exclusive, revocable, worldwide, and non-transferable license to use the System for the creation of digital business cards, NFC tags, and QR codes for personal or business purposes, subject to these Terms.

4.2 Ownership of Content

The User retains ownership of the intellectual property rights in User Content uploaded to the System, subject to the rights of third parties.

All other content in the System, including but not limited to code, software, databases, designs, and displayed materials, belongs to us or is licensed to us and is protected under Israeli and international intellectual property laws.

4.3 License to User Content

The User grants us an unconditional, non-exclusive, perpetual, worldwide, transferable, royalty-free license to use, edit, reproduce, distribute, display, broadcast, sublicense, adapt, publish, and modify User Content, including text, images, files, or any other information uploaded by the User, for the purpose of operating, improving, and promoting the System.

Additionally, the User agrees that we may use User Content for marketing, advertising, research, or any other purposes at our sole discretion, including but not limited to creating promotional materials, marketing campaigns, and displaying such content on our website or other media channels, without requiring further consent or payment.

The User represents that the User Content does not infringe third-party rights and that the license is granted knowingly and voluntarily.

Not to integrate, distribute, or make the System accessible via any website, FTP server, or similar platform without our prior written consent;

1. User Content and Responsibility

The User is solely responsible for the Content uploaded, including its accuracy, legality, and the rights to use it.

The User agrees not to hide, remove, or alter advertisements by any means, including HTML/CSS manipulation.

We are not responsible for the content of advertisements, including errors, inaccuracies, or omissions.

12.3 Device Damage

Subject to consumer rights, we shall not be liable for any damage to the User’s devices or digital content resulting from the use of the System, unless caused by our lack of reasonable care or skill.

12.4 Business Limitations

For business Users, to the fullest extent permitted by law, we shall not be liable for:

Loss of profits, sales, business, or revenue;

Business interruption;

Loss of business opportunities, goodwill, or anticipated savings;

Any indirect or consequential loss or damage.

12.5 External Factors

We are not liable for interruptions or unavailability of the System due to external factors, including but not limited to ISP equipment failures, hosting failures, network failures, natural disasters, acts of war, or legal restrictions and censorship.

12.6 Exclusions

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

We reserve the right to suspend the User’s access to the System, suspend or terminate any Business Card Link, NFC tag, or QR code, or prevent the download of Business Card Files in the event of a breach of these Terms, especially violations of the Acceptable Use Policy (Section 3).

13.2 Termination

We may terminate this agreement at any time without prior notice if, in our sole discretion, we determine that the User has breached or is suspected of breaching any of these Terms.

These Terms, the agreement between us and the User, and the relationship between the parties are governed by the laws of the State of Israel.
